Business and Investor Visas

Business and Innovation Stream- Visa 188
This visa is for foreign investors or business owners who want to invest in new or existing businesses in Australia or who want to make a designated investment in Australian State or Territory Government bonds.

Investor Stream- Visa 188
This provisional visa requires that at least AUD 1.5 million be invested in an Australian state or territory, and that a business or investment activity be maintained in Australia.
Significant investor stream- Visa 188
This provisional visa is for people who invest at least AUD 5 million in Australian investments and who meet certain requirements, maintaining investment activity in Australia. Applicants can be nominated by a State or Territorial Government on behalf of the Australian Government.

Premium investor – Visa 188
For people who want to invest at least AUD 15 million in the fulfilment of premium investments in Australia and want to maintain business activity and investment or philanthropic contributions in the country. Applicants must be nominated by Austrade on behalf of the Australian Government.

Entrepreneur stream- Visa 188
This provisional visa allows you to carry out business activities in Australia. Applicants must be nominated by a state or territorial government.

Business innovation and investment (permanent) – Visa 888
This visa is the second stage of the Business Innovation and Investment visa. You can apply for this permanent 888 visa after having the provisional visa 188, either for 2 years with the business innovation visa or 4 years with the investor visa.

Business Talent (Permanent) – Visa 132
This visa allows you to establish a new business or develop an existing one in Australia.
Significant Business History stream: This visa is for experienced business owners to operate a new or existing business in Australia.
Venture Capital Entrepreneur stream: This visa is for individuals who have raised venture capital funds from a member of the Australian Investment Council (AIC) (formerly known as Australian Private Equity and Venture Capital Association Limited (AVCAL)).

Business Innovation and Investment (Provisional) visa (subclass 188) / Investor stream

This visa costs AUD 5,375 for the main applicant.
The charges for each family member who applies for the visa with you will be:
– Additional applicant over 18 years: 2,685 AUD
– Additional applicant under 18 years old: AUD 1,345

You should bear in mind that there will be an additional charge for any applicant over 18 who has less functional English. This charge is the second payment.
– Lead applicant: AUD 9,795
– Family members: AUD 4,890
You may also have to pay for medical checks, police certificates, and biometrics.

Significant Investor stream

This visa costs AUD 7,880 for the main applicant.
The charges for each family member who applies for the visa with you will be:
– Additional applicant over 18 years old: AUD 3,940
– Additional applicant under 18: AUD 1,975
You should bear in mind that there will be an additional charge for any applicant over 18 who has less functional English. This charge is the second payment:
– Lead applicant: AUD 9,795
– Family members: AUD 4,890
You may also have to pay for medical checks, police certificates, and biometrics.

Business Innovation Extension stream / Significant Investor Extension stream

This visa costs 645 AUD for the main applicant.
The charges for each family member who applies for the visa with you will be:
– Additional applicant over 18 years: 325 AUD
– Additional applicant under 18 years old: AUD 165
You should bear in mind that there will be an additional charge for any applicant over 18 who has less functional English. This charge is the second payment:
– Lead applicant: AUD 9,795
– Family members: AUD 4,890

Premium Investor stream

This visa costs AUD 9,455 for the main applicant.
The charges for each family member who applies for the visa with you will be:
– Family members over 18 years old: AUD 4,725
– Family members under 18: AUD 2,365
You should keep in mind that there will be an additional charge for any applicant over 18 years of age who e have less functional English. This charge is the second payment:
– Lead applicant: AUD 9,795
– Family members: AUD 4,890
You may also have to pay for medical checks, police certificates, and biometrics.

Entrepreneur stream

This visa costs AUD 4,045 for the main applicant.
The charges for each family member who applies for the visa with you will be:
– Additional applicant over 18 years old: AUD 2,025
– Additional applicant under 18: AUD 1,010
You should bear in mind that there will be an additional charge for any applicant over 18 who has less functional English. This charge is the second payment:
– Lead applicant: AUD 9,795
– Family members: AUD 4,890

Business Talent (Permanent) visa

The visa costs AUD 7,855 for the main applicant.
The charges for each family member who applies for the visa with you will be:
– Additional applicant over 18 years old: AUD 3,930
– Additional applicant under the age of 18: 1,960 AUD
You should bear in mind that there will be an additional charge for any applicant over 18 who has less functional English. This charge is the second payment:
– Lead applicant: AUD 9,795
– Family members: AUD 4,890
You may also have to pay other costs for health checks, police certificates, and biometrics.

For business and investor visas there are no standard processing times available for transmission.

However, your request may take longer to process if:

– You have not submitted a complete application
– You do not include all the documents that are required or additional information that they ask for.
– Verification may take time to perform the necessary checks on the supporting information provided.
– The time it takes to receive additional information from outside agencies, regarding health, character, and national security requirements.
– They will not process your application if you do not pay the visa application fee.

Basic Eligibility Criteria:
– Submit an expression of interest (EOI) in SkillSelect.
– Nominated by a state or territorial government agency or Austrade.
– Invited to apply for the visa.
– Have a functional English language.
– You must be under the age of 55, although a state or territory may waive this requirement if your proposed business will be of exceptional economic benefit to the region where it will operate.
– Meet the health requirement.
– Meet the character requirement.
– Sign the statement of Australian values.
– Have paid your debt (if any) to the Australian government.
– Not having had a cancelled visa or a previously rejected applications.

Significant Business History stream
– Have business acumen and ambition.
– Owning a substantial part of the business.
– Have total net assets of A $ 1.5 million or more.
– Have an annual turnover of 3 million or more AUD.
– Have total net assets of AUD 400,000 or more.

Business Innovation stream.
– Have commercial property.
– Own personal and business assets of at least AUD 800,000.
– Get at least 65 on the points test.
– Have a successful business career.
– You must have a successful business career and a genuine desire to continually own and run a business in Australia.
– Not have a history of engaging in unacceptable activities.
Investor stream.
– Own and manage business and personal assets and investments.
– Have the right experience.
– Get at least 65 on the points test.
– You intend to live in a specific state or territory.
– You must have a genuine intention to live for at least 2 years in the state or territory in which you made the investment application.

Significant Investor stream
– Be able to invest at least AUD5 million.
– Not have a history of engaging in unacceptable activities.
– Sign the statement of Australian values.

Business Innovation Extension stream
– Demonstrate the need to be a resident of Australia to operate the core business.
– You must demonstrate that your business activities are of a nature that will require a substantial presence in Australia to operate your business and manage its day-to-day affairs.
– Have maintained an ownership interest in your designated core business.
– Have maintained their commitment to participate directly in the daily management and decision-making of the company.
– You must have a current nomination from a state or territorial agency before being invited to apply for this visa.

Significant Investor Extension stream
– Not have had more than one significant investor extension visa

A Business Innovation and Investment Visa (Provisional) (subclass 188)/ Significant investor extension visa.
– You must continue to maintain your significant investment in accordance with the agreement in force at the time you applied for this visa.

Premium Investor stream
– Receive an invitation to apply.
– Make a compliant premium investment of at least AUD 15 million.
– Have net assets of at least AU $15 million.
– Not have a history of engaging in unacceptable activities
– Agree not to take action against the Commonwealth

Entrepreneur stream
– Receive an invitation to apply, you must send an Expression of Interest (EOI). If a government agency in an Australian state or territory accepts your EOI and nominates you, they will invite you to apply for this visa.
– Be nominated by a state or territorial government agency before being invited to apply for this visa.

Business Innovation stream
You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
You must also comply with certain business obligations and obey Australian labour laws.
As long as you are the holder of this visa, you must:
Have a substantial ownership interest in a business in Australia.
Participate in their daily management, at a higher level in the business, you must do at least one of these things:
– Competitiveness within the Australian economy.
– Develop commercial links with international markets.
– Employing people in Australia.
– Export Australian products.
– Introduce new or improved technology.
– Produce goods or services that Australia would otherwise import.

Investor stream
– You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
– You must also agree to continue to hold your investment and comply with Australian workplace laws.
– To be eligible for a Business Innovation and Investment (Permanent) visa (subclass 888) in the flow of investors, you must live in the state or territory in which you made the designated investment for at least 2 years during the period your visa is valid.
– Maintain your investment.
– To be eligible for the Business Innovation and Investment (Permanent) visa (subclass 888) for investors, you must maintain your investment in an Australian state or territory for at least 4 years.
– The income you get from your investment in Australia is subject to Australian tax law.

Significant Investor stream
– You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
– To be eligible for a Business Innovation and Investment (Permanent) visa (subclass 888) in the Significant Investor stream, you must live in Australia for at least 40 days per year for the duration of your provisional visa. Or your spouse must live in Australia for at least 180 days a year during the term of your provisional visa. These days do not need to be consecutive.
– Maintain your investment.

Business Innovation Extension stream
– You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
– You must comply with certain business obligations and obey Australian labor laws. As long as you are the holder of this visa, you must:
– Have a substantial ownership interest in a business in Australia.
– Have a genuine and realistic commitment to participate in your daily management, at a higher level.

In business, you must do:
– Competitiveness within the Australian economy.
– Develop commercial links with international markets.
– Employing people in Australia.
– Export Australian products.
– Introduce new or improved technology.
– Produce goods or services that Australia would otherwise import.

Significant Investor Extension stream

– You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
– To be eligible for a Business Innovation and Investment (Permanent) visa (subclass 888) in the Significant Investor stream, you must live in Australia for at least 40 days per year for the duration of your provisional visa. Or your spouse must live in Australia for at least 180 days a year during the term of your provisional visa. These days do not need to be consecutive.
– Maintain your investment.

Premium Investor stream
– You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
– If you request an Investment and Business Innovation (visa permanent (subclass 888) Premium Investor stream, you must have a genuine and realistic commitment to maintaining business and investing activity.
– You must hold your A $15 million investment for a minimum of 12 months and follow Australian workplace laws.

Entrepreneur stream
– You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
– You must fulfill certain obligations related to your business activities. You must also obey Australian labor laws.
– You must have a financing agreement with a third party of at least 200,000 AUD. There are other eligibility requirements for this visa.

Business Talent (Permanent) visa (subclass 132)

– You and the members of your family who are part of your application must comply with all the conditions of the visa and Australian laws.
– You must fulfill your commercial obligations.

Business Talent (Permanent) visa (subclass 132): You can stay in Australia permanently.

Business Innovation stream: You can stay in Australia for up to 4 years and 3 months.

Investor stream: You can stay in Australia for up to 4 years and 3 months.

Significant Investor Extension stream: This is a provisional visa, and you can stay for 6 years after the grant date of the original Business Innovation and Investment (Provisional) visa (subclass 188) Significant investor flow.

Business Innovation Extension stream: This is a provisional visa. You can stay in Australia for up to 6 years after the grant date of the Business Innovation and Investment (Provisional) visa (subclass 188) Flow of Innovation that you had at the time of application; or up to 8 years if COVID-19 concessions apply.

Premium Investor stream: This is a provisional visa. You can stay in Australia for 4 years and 3 months.

Entrepreneur stream: This is a provisional visa. You can stay in Australia for 4 years and 3 months.
